What are the terms + conditions?

1. The prize draw (‘the Prize Draw’) is conducted by The Trustee for Motorbike Unit Trust, ABN 74 841 256 696
of, 402 Hoxton Park Road Prestons NSW 2170 Australia (‘the Promoter’) in Australia. Customer service
enquiries should be directed to GASGAS Customer Assistance: 1800 644 771.
2. Entry to the Prize Draw constitutes acceptance of these Conditions. All entry instructions and prize
information published by the Promoter or the Promoter’s agent form part of these Conditions.
3. All times and dates are times and dates in Adelaide, Australia (which will either be in Australian Central
Daylight Time or Australian Central Standard Time, whichever is applicable in Adelaide, Australia) and are
based on the 24 hour clock. 00:00hrs is the start of a day and 23:59hrs is the end of a day.
Entry
4. Information on how to enter forms part of the conditions of entry.
5. To be eligible for the Prize Draw, all entrants must make a qualifying purchase, scan the QR code on the
entry form to complete an online form, and upload a copy of the tax invoice. Both the qualifying purchase
and the online form lodgement must occur between 00:00 (Midnight) Saturday 8 October 2022, and 23:59
Friday 23 December 2022.
6. Entrants must be Australian residents aged 18 years or over to enter the Prize Draw.
7. All employees of the Promoter, its Dealerships, related bodies corporate, the Promoter’s Agent and their
immediate families are ineligible for the Prize Draw.
8. There is no cost to enter the Prize Draw other than the costs paid by the entrants to access the online entry
website via their internet service provider. Any costs associated with accessing the promotional website is
the entrant’s responsibility and is dependent on the internet service provider used.
9. Entrants’ personal information will be collected by the Promoter to enable them to administer the Prize
Draw, and notify and publish the winners. The personal information of the winner may be provided to others
assisting in the conduct of this Prize Draw, including the Promoter’s Agent, prize suppliers and deliverers,
and to regulatory authorities. Entrants may contact the Promoter by post to Privacy Officer, GASGAS Australia
402 Hoxton Park Road Prestons NSW 2170 or by calling 1800 644 771 during business hours to opt-out,
request access to, or corrections of any of their collected personal information that is held by the Promoter.

10. If an entrant does not provide complete and accurate personal information the Promoter may, in their
absolute discretion, determine that they are not eligible to win a prize.
11. If for any reason any aspect of this competition is not capable of running as planned, including by reason of
computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud,
technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion
cancel, terminate, modify or suspend the competition and invalidate any affected entries, or suspend or
modify a prize, subject to State or Territory regulation.
12. Caution: Any attempt to cause damage to any website or the information on any website associated with
this competition, to cause damage to or to otherwise undermine the fair and legitimate operation of this
competition may be a violation of criminal and civil laws. The Promoter reserves the right to seek damages
to the fullest extent permitted by law in the event that any such attempt is made, whether or not that
attempt results in any such damage, interference or undermining.
Prize
13. There is one prize to be won – a once-in-a-lifetime VIP experience for you and your mini-racer. A 5-day VIP
experience to the 2023 San Diego Supercross for two adults and one child. The prize consists of:
a. Flights from the winner’s nearest capital city in Australia to Los Angeles, USA for 2 adults and 1
child. Flight provider chosen by the Promoter.
b. 5 nights accommodation at a hotel chosen by the Promoter.
c. Transfers provided by the Promoter and will be sharing with others.
i. From San Diego airport to hotel accommodation on arrival;
ii. To and from the Supercross event on each day; and
iii. From hotel accommodation to San Diego airport on departure.
d. 3 x San Diego Supercross VIP Suite Tickets, in a shared suite with other guests.
14. Note: Final dates for the 2023 San Diego AMA Supercross are yet to be finalised, and estimated to be late
January 2023. Location and Supercross event are subject to change at the Promoter’s discretion.
15. The total prize pool is estimated at $14,300. The prize is not transferrable and not redeemable for cash. If
the winner claims the prize but is then unable to take the trip the prize will be forfeited.
16. If the prize (or part of the prize) is unavailable for whatever reason beyond the control of the Promoter,
including without limitation, natural disasters, acts of God, civil unrest, strike, war, act of terrorism,
epidemic or pandemic, or public health order the Promoter, in its discretion, reserves the right to substitute
the prize (or that part of the prize) with a prize to the equal value and/or specification.
17. It is the winner’s responsibility to ensure they have the required visas, vaccinations and passports which
meet the requirements of immigration and other government authorities at every destination. Any fines,
penalties or expenditure incurred as a result of such documents not meeting the requirements of those
authorities will be solely the responsibility of the winner.
18. The winner is responsible for all other expenses including any additional accommodation requested,
spending money, meals, drinks, other ground travel not specified, laundry charges, activities, incidentals,
taxes, energy surcharges, gratuities, service charges, passports, visas, travel insurance and all other
ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in
the event of unforeseen circumstances.
19. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any
destination or as part of the prize.
Winner
20. The Prize Draw will be conducted on Saturday 24 December 2022 at Op2ma Pty Ltd, Level 9, 44 Waymouth
St, Adelaide SA 5000 Australia at 10:00.
21. The winner will be notified in writing via email on Sunday 25 December 2022. The winner must acknowledge
and claim their prize by 23:59 Tuesday 27 December 2022. If the prize is not claimed within the time period,
an unclaimed Prize Draw will take place.
22. The winner’s name will be announced at facebook.com/ktmaustralia within 10 working days of the draw
and remain on the page for not less than 28 days.
23. The winner will be selected at random from all entries completed online within the specified time period.
24. In the event of a prize not being claimed, an unclaimed Prize Draw will be held on Wednesday 28 December
2022 at Op2ma Pty Ltd, Level 9, 44 Waymouth St, Adelaide SA 5000 Australia at 10:00. The winner will be
notified in writing via email on Wednesday 28 December 2022. The winner must acknowledge and claim
their prize by 23:59 Monday 2 January 2023. The winner’s name will be announced at
facebook.com/ktmaustralia within 10 working days of the draw and remain on the page for not less than
28 days.
Liability
25. To the extent permitted by law, the Promoter and the Promoter’s Agent are not responsible and liable for:
 Inaccurate/incorrect transcription of entry information;
 Purported entries that are not received for any reason, including because they are lost, misdirected or
stolen, or that are received, but are late illegible, incomplete, sent with insufficient postage (where entry
is by post), or sent other than as directed in the entry instructions;
 Any problems or technical failures of any kind, including malfunction of any telephone network or lines,
computer online systems or network, servers or providers, computer equipment or software;
 The unavailability or inaccessibility of any service whether or not caused by traffic congestion on the
Internet or at any website;
 Unauthorised human intervention in any part of the competition; or
 Electronic or human error which may occur in the administration of the competition.
26. To the full extent permitted by law, the Promoter their associated companies and agencies and all those
entities’ personnel (‘the Relevant Parties’) exclude all liability for any loss (including any damage, claim,
injury, cost or expense) whatsoever which is suffered or incurred by any entrant arising out of or otherwise
in connection with the competition or prizes, including:
 Any indirect, economic or consequential loss;
 Any loss arising from or contributed to by the negligence of a Relevant Party;
 Any liability for personal injury or death; and
 Use of a prize.
27. The Promoter’s decision is final and no correspondence will be entered into.
